The dev.mtoinette.com website  (the “Site”) is the showcase and online sales site of the company M’Toinette, and its purpose is the retail sale of equipment and services for haberdashery and creative hobbies.

ARTICLE 4. ACCEPTANCE OF CONDITIONS OF USE AND SALE

Access to and use of the Site are subject to acceptance and compliance with these General Terms and Conditions of Use and the General Terms and Conditions of Sale (“GTC”).

The publisher reserves the right to modify, at any time and without notice, the Site and services as well as the GTCU, GTC and charter for the protection of personal data and the management of cookies, in particular to adapt to changes in the Site by providing new functionalities or deleting or modifying existing functionalities.

It is therefore advisable for the user to refer before any navigation to the latest version of the GTCU, GTC and charter for the protection of personal data and management of cookies, accessible at any time on the Site. In case of disagreement with one of these documents, no use of the Site can be made by the user.

ARTICLE 5. ACCESS AND NAVIGATION

The publisher implements the technical solutions at its disposal to allow access to the Site 24 hours a day. 7 days a week. It may, however, at any time suspend, limit or interrupt access to the Site or certain pages thereof in order to make updates, notifications of its content or any other action deemed necessary for the proper functioning of the Site.

The connection and navigation on the M’Toinette Site constitute unreserved acceptance of these General Terms and Conditions of Use and the General Terms and Conditions of Sale, regardless of the technical means of access and the terminals used.

The GTCU and the GTC apply, as necessary, to any variation or extension of the Site on existing or future social and/or community networks.

ARTICLE 6. MANAGEMENT OR SITE

For the proper management of the Site, the publisher may at any time:

  • Suspend, interrupt or limit access to all or part of the Site, reserve access to the Site or certain parts of the Site, to a specific category of user,
  • Delete any information that may disrupt its operation or contravene national or international laws or the rules of Netiquette,
  • Suspend the Site in order to make updates.

ARTICLE 7. SERVICES RESERVED FOR REGISTERED USERS

  1. REGISTRATION

Access to certain services, and in particular to all paid services, is subject to the user’s registration.

Registration and access to the services of the Site are reserved exclusively for capable natural persons, having completed and validated the registration form available online on the M Toinette Site, as well as these General Terms and Conditions of Use and General Terms and Conditions of Sale.

When registering, the user undertakes to provide accurate, sincere and up-to-date information on his person and his civil status. The user must also regularly check the data concerning him in order to maintain its accuracy.

The user must therefore provide a valid email address, on which the Site will send him a confirmation of his registration for its services. An email address cannot be used multiple times to register for the Services.

Any communication made by M’Toinette and its partners is therefore deemed to have been received and read by the user. The latter therefore undertakes to regularly consult the messages received on this email address and to respond within a reasonable time if necessary.

Only one registration for the services of the Site is allowed per natural person.

The user is assigned an identifier allowing him to access a space to which access is reserved for him (hereinafter “Personal Space”), in addition to entering his password.

The username and password can be modified online by the user in his Personal Space. The password is personal and confidential, the user agrees not to communicate it to third parties.

M’Toinette reserves in any case the right to refuse a request for registration to the services in case of non-compliance by the user with the provisions of these General Conditions of Use or the General Conditions of Sale.

  1. UNSUBSCRIBING

The regularly registered user may at any time request his unsubscription by sending a letter to the company M’Toinette, or by using the contact form provided for this purpose. Any unsubscription from the Site will be effective within thirty days.

  1. DELETION OF THE PERSONAL SPACE AT THE INITIATIVE OF THE PUBLISHER OF THE SITE

It is brought to the attention of the user that the publisher reserves the right to delete the personal space of any User who contravenes these conditions of use and sale, and more particularly in the following cases:

  • If the user makes unlawful use of the Site;
  • If the user, when creating his personal space, voluntarily transmits erroneous information to the Site;
  • If the user has not been active on his personal space for at least one year.

In the event that the publisher decides to delete the user’s personal space for one of these reasons, it cannot constitute damage to the user whose account has been deleted.

This deletion does not constitute a waiver of legal proceedings that the publisher may take against the user who has violated these rules.

ARTICLE 8. RESPONSIBILITIES

The publisher is only responsible for the content that he has edited himself. The publisher is not responsible for:

  • In the event of problems or technical or computer failures or compatibility of the Site with any hardware or software whatsoever;
  • Direct or indirect, material or immaterial, foreseeable or unforeseeable damage resulting from the use or difficulties of use of the Site or its services,
  • The intrinsic characteristics of the Internet, in particular those relating to the unreliability and lack of security of the information circulating there;

M’Toinette declines all responsibility for any malfunctions that may occur on the Site and result in loss of data or unavailability of access to the information produced on it.

The elements presented on the Site are subject to change without notice and are made available to users, without any guarantee of any kind, express or tacit.

In addition, the Site cannot guarantee the accuracy, completeness, and timeliness of the information disseminated therein.

The user is responsible for:

  • The protection of its equipment and data;
  • The use he makes of the Site or its services;

If it does not comply with the letter or the spirit of these general conditions of use.

ARTICLE 9. HYPERTEXT LINKS

The Site may contain hypertext links pointing to other Websites over which M’Toinette has no control. Despite the prior and regular checks carried out by the publisher, it declines all responsibility for the content that can be found on these Sites.

The publisher authorizes the establishment of hypertext links to any page or document of its Site provided that the establishment of these links is not carried out for commercial or advertising purposes.

In addition, the prior information of the publisher of the Site is necessary before any hypertext link is set up.

Excluded from this authorization are Sites disseminating information of an illicit, violent, controversial, pornographic, xenophobic nature or that may offend the sensitivity of the greatest number.

Finally, M’Toinette reserves the right to remove at any time a hypertext link pointing to its Site, if the Site considers it not in accordance with its editorial policy.

It applies to customer accounts created in store and data collected on the www.mtoinette.com site. This document is available on the website www.mtoinette.com through a link at the bottom of the page on the home page.

ARTICLE 11: INTELLECTUAL PROPERTY

The www.mtoinette.com site is the exclusive property of the publisher. The structuring of the Site but also the texts, graphics, images, photographs, sounds, videos and computer applications that compose it are the property of the publisher and its suppliers and are protected as such by the laws in force under intellectual property and copyrights.

All elements of the Site are and remain the intellectual and exclusive property of M’Toinette or relate to supplier copyrights. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the Site whether they are software, visual or sound, except with prior written agreement. Any total or partial reproduction is likely to constitute an offense of counterfeiting.

Access to the Site does not constitute recognition of a right and, in general, does not confer any intellectual property rights relating to an element of the Site, which remain the exclusive property of the publisher.
